1. Acceptance of Terms
By installing or using DH Field EMR (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
DH Field EMR is a free web application for documenting medical encounters during international medical outreach. It provides patient record management, clinical documentation, analytics, and optional synchronization to a cloud database that you provide and control.
3. Global Health Use Only
IMPORTANT: DH Field EMR is designed exclusively for international global-health field medicine and medical outreach operating outside the United States.
It is not intended for use within the United States healthcare system, is not compliant with the Health Insurance Portability and Accountability Act (HIPAA) or other U.S. healthcare regulations, and is not a certified Electronic Health Record (EHR) system under any regulatory framework. It must not be used as a substitute for a certified medical record system where one is required by law.
4. Medical Disclaimer
DH Field EMR is a data-entry and record-keeping tool only. It does not provide medical advice, diagnosis, or treatment recommendations.
All clinical decisions must be made by qualified healthcare professionals. The medication builder, presets, and any calculated values are convenience features only and must be independently verified by a licensed practitioner before use. Damico Health Inc. assumes no liability for clinical decisions made using the App.
5. Data Responsibility
You and your organization are solely responsible for:
- The security and privacy of all patient data entered into the App
- Compliance with local data-protection laws in your country of operation
- Obtaining appropriate patient consent for data collection and storage
- Maintaining adequate backups of your data
- Protecting your Supabase credentials and controlling access to devices that hold patient information
- Appropriate handling and eventual deletion of patient records
Damico Health Inc. does not access, view, or store your patient data. Records are stored locally on your device and, if you enable sync, in a Supabase cloud project that you create and control. We do not operate that database.
6. Free
The App is provided free of charge. There are no subscriptions or fees to use it. Any voluntary donations are processed by PayPal and are non-refundable except as required by law.
7. Acceptable Use
You agree to use the App only for legitimate medical record-keeping in international field-medicine settings. You will not:
- Use the App for any unlawful purpose
- Enter false, misleading, or fictitious patient data
- Use the App to harm patients or violate medical ethics
- Share credentials to your data with unauthorized parties
- Misrepresent a modified version as the official Damico Health release, or use the Damico Health name or logo in a way that implies endorsement
8. Intellectual Property & License
Copyright in the App is held by Damico Health Inc. The "DH Field EMR" and "Damico Health" names and logos are trademarks of Damico Health Inc.
9. No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Damico Health Inc. does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, that it is suitable for any particular medical or regulatory requirement, that data will be preserved without loss, or that synchronization will always function properly.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAMICO HEALTH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO loss of patient data, medical errors arising from use of the App, loss of profits or business, service interruptions, or any harm resulting from your use of or inability to use the App.
Because the App is provided free of charge, the total aggregate liability of Damico Health Inc. for any claim arising from these Terms or your use of the App shall not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Damico Health Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, clinical decisions made using the App, or patient-data privacy violations resulting from your actions.
12. Termination & Availability
We may discontinue or change the hosted version of the App and this website at any time. These Terms continue to govern your use of the App.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in the State of Florida.
14. Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted to this page. Continued use of the App after changes constitutes acceptance.
