1. Acceptance of Terms

By installing or using DH EMR Field or DH EMR Clinic (together, the "Apps"), you agree to these Terms of Service. If you do not agree, do not use the Apps.

2. Description of Service

The Apps are free web applications for documenting patient visits in international medical outreach and global-health clinics. DH EMR Field records visits on a device, with optional synchronization to a cloud database that you provide and control. DH EMR Clinic runs a live clinic with staff accounts against a cloud database that you provide and control. Both provide patient record management, clinical documentation and analytics.

3. Global Health Use Only

IMPORTANT: The Apps are designed exclusively for international global-health medicine and medical outreach operating outside the United States.

They are not intended for use within the United States healthcare system, are not compliant with the Health Insurance Portability and Accountability Act (HIPAA) or other U.S. healthcare regulations, and are not certified Electronic Health Record (EHR) systems under any regulatory framework. They must not be used as a substitute for a certified medical record system where one is required by law.

4. Medical Disclaimer

The Apps are data-entry and record-keeping tools only. They do not provide medical advice, diagnosis, or treatment recommendations.

All clinical decisions must be made by qualified healthcare professionals. The medication builder, presets, and any calculated values are convenience features only and must be independently verified by a licensed practitioner before use. Damico Health Inc. assumes no liability for clinical decisions made using the Apps.

5. Data Responsibility

You and your organization are solely responsible for:

  • The security and privacy of all patient data entered into the Apps
  • Compliance with local data-protection laws in your country of operation
  • Obtaining appropriate patient consent for data collection and storage
  • Maintaining adequate backups of your data
  • Protecting your Supabase credentials and staff accounts, and controlling access to devices that hold patient information
  • Appropriate handling and eventual deletion of patient records

Damico Health Inc. does not access, view, or store your patient data. Records are stored locally on your devices and, when you use a cloud project, in a Supabase project that you create and control. We do not operate that database.

6. Free

The Apps are provided free of charge. There are no subscriptions or fees to use them.

7. Acceptable Use

You agree to use the Apps only for legitimate medical record-keeping in international outreach and global-health clinic settings. You will not:

  • Use the Apps for any unlawful purpose
  • Enter false, misleading, or fictitious patient data (outside the demos on this site, which are fictional by design)
  • Use the Apps to harm patients or violate medical ethics
  • Share credentials or staff accounts with unauthorized parties
  • Misrepresent a modified version as the official Damico Health release, or use the Damico Health name or logo in a way that implies endorsement

8. Intellectual Property & License

Copyright in the Apps is held by Damico Health Inc. The "DH EMR", "DH EMR Field", "DH EMR Clinic" and "Damico Health" names and logos are trademarks of Damico Health Inc.

9. No Warranty

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Damico Health Inc. does not warrant that the Apps will be uninterrupted or error-free, that defects will be corrected, that they are suitable for any particular medical or regulatory requirement, that data will be preserved without loss, or that synchronization will always function properly.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAMICO HEALTH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO loss of patient data, medical errors arising from use of the Apps, loss of profits or business, service interruptions, or any harm resulting from your use of or inability to use the Apps.

Because the Apps are provided free of charge, the total aggregate liability of Damico Health Inc. for any claim arising from these Terms or your use of the Apps shall not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless Damico Health Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Apps, your violation of these Terms, your violation of any third-party rights, clinical decisions made using the Apps, or patient-data privacy violations resulting from your actions.

12. Termination & Availability

We may discontinue or change the hosted version of the Apps and this website at any time. These Terms continue to govern your use of the Apps.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in the State of Florida.

14. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted to this page. Continued use of the Apps after changes constitutes acceptance.

DH EMR is not a certified EHR and is not HIPAA-compliant. It is intended for global-health use outside the US.
